PAIA Manual
Our manual under Section 51 of the Promotion of Access to Information Act 2 of 2000 — how to request access to records we hold.
This manual is published in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), as a private body. It explains what records Nyandeni Holdings Security Services (Pty) Ltd holds, which of them are available without a formal request, and how to request access to the rest. It works alongside our Privacy Policy, which covers POPIA rather than PAIA — PAIA governs requesting access to recorded information generally, while POPIA governs how we process personal information specifically.
1. About this body
Nyandeni Holdings Security Services (Pty) Ltd, registered address 1109 J. Mahomed Street, Brooklyn, Pretoria, 0181, South Africa. Company registration number: [insert CIPC company registration number]. PSIRA registration number: [insert PSIRA registration number].
2. Information Officer
Information Officer: Xolani C. Mthembu, Director. Under Section 1 of POPIA, the information officer of a private body is, by default, its CEO or equivalent head unless another person is designated and registered with the Information Regulator — this is our current position and will be updated here if a Deputy Information Officer is appointed.
Requests and enquiries under this manual can be directed to: info@nyandeniholdings.co.za or 010 065 3264.
3. The guide to using PAIA
The South African Human Rights Commission is required to publish a guide, in each official language, on how to use PAIA, including the contact details of every information officer in the country. That guide is available from the Information Regulator, which has taken over this function, or the South African Human Rights Commission.
4. Records we hold
In the ordinary course of business, we hold records including:
- Client enquiry, assessment and contract records
- Employee and HR records (contracts, PSIRA registrations, training certificates, leave records)
- Financial, accounting and tax records
- Operational and incident records related to the security services we provide
- Regulatory and compliance records (PSIRA, SASSETA, COIDA)
- Website and marketing records, as described in our Privacy Policy
5. Records available without a request
Some information is already public and does not require a formal PAIA request — for example, the service descriptions, company information and policies published on this website. Where you're simply looking for general information about our services, company or policies, please check this website first or contact us directly — it's usually quicker than a formal request.
6. How to request access to other records
For records not already public, you may submit a request for access under PAIA. There is no prescribed form you must use, although the Information Regulator publishes template request forms (Form 2 of the PAIA Regulations for a private body). Your request should include:
- Your full name, contact details and, if applicable, proof of identity
- Sufficient detail to identify the record you're requesting
- The form of access you want (copy, inspection, etc.)
- Why you believe you're entitled to the information, if relying on a specific right
Send requests to the Information Officer using the contact details in Section 2. We will acknowledge your request and, where a fee applies, notify you of it before processing continues further.
7. Fees
PAIA allows a private body to charge a prescribed request fee before processing a request, plus access fees for reproduction (for example, photocopying) where access is granted. These amounts are set nationally, by regulation, under PAIA — not set by us — and can change from time to time, so we don't quote a fixed number on this page. We will confirm the applicable fee, if any, when we acknowledge your request; current prescribed amounts can also be confirmed directly with the Information Regulator.
8. Timeframe for a decision
We will respond to a valid request within the statutory period, generally 30 days of receipt, which may be extended once by a further period in the circumstances PAIA allows. If you don't receive a decision within the applicable period, the request is deemed refused and you may take it further as PAIA provides.
9. Grounds on which a request may be refused
PAIA sets out specific grounds on which access to a record may be refused — for example, where disclosure would unreasonably disclose another person's personal information, would be privileged, or would prejudice certain commercial or security interests. Any refusal will state the ground relied on and your right to lodge an internal appeal or complain to the Information Regulator.
10. Your right to complain
If you're unhappy with how a request was handled, you may lodge a complaint with the Information Regulator.
